FSMA 204 es ley federal desde 2011. La sección 204 tiene compliance obligatorio en julio de 2028. Pero la presión comercial ya está activa: desde agosto 2025, Walmart cobra 3% de chargeback por entregas no conformes. Costco, Trader Joe's y Sysco escalan lo mismo. El estándar ya se aplica.

FSMA 204 has been federal law since 2011. Section 204 becomes fully enforced in July 2028. But commercial pressure is already active: since August 2025, Walmart charges a 3% chargeback for non-compliant deliveries. Costco, Trader Joe's, and Sysco are escalating the same.   • The rule does apply to Food Traceability List (FTL) foods produced outside the US.

July 2026: multi-state recall of GreenWise-brand frozen organic blueberries sold at Publix. Origin: Frutas y Hortalizas del Sur S.A. (San Carlos, Chile). E. coli strain O145:H28. Critical window: first illness May 11, recall July 3 — 2-month gap between exposure and regulatory action. 8 US states affected. In a world with end-to-end traceability, those 2 months are 2 hours.

The absence of end-to-end traceability cost lives. FDA cites this case as the direct trigger of the Food Traceability Final Rule.

Grocery Dive (Q2 2026) confirma el roster expandido: Walmart, Kroger, Sam's Club, Costco, Whole Foods, Albertsons, KeHE, UNFI ya en enforcement — Target se suma, y Aldi, H-E-B, Meijer, Publix y Wegmans corren timelines más rápidos que la FDA. En foodservice, Sysco + iFoodDS + ReposiTrak es hoy exigible, no aspirational. Requerimiento aplica a todos los alimentos, no solo FTL. Walmart / Sam's Club: 3% de chargeback bajo OTIF desde agosto 2025. Doble régimen: la FDA da tiempo hasta 2028, los retailers no.

Fallo: APHIS no consideró alternativas ni proveyó data completa. Cuando la trazabilidad y documentación no son end-to-end, el acceso al mercado US queda legalmente vulnerable.

September 2025: the Federal Court of DC suspended the "Systems Approach" that allowed Chilean grape imports without fumigation. Ruling: APHIS didn't consider alternatives or provide full data. When traceability and documentation aren't end-to-end, US market access becomes legally vulnerable.
